Mediation
What is mediation?
Mediation is an alternative method of resolving disputes. Some other well known types of Alternative Dispute Resolution (ADR) are Arbitration and Early Neutral Evaluation.
Why mediate?
Key reasons are:
The parties are in control and chose a solution that is agreeable to all parties
For complex cases it can narrow the issues
Reduces costs and can cost less than going to court
How does it work?
4 easy steps:
The mediator will agree a date and time of the mediation appointment with both parties
During the meeting, the mediator will work with the parties individually to discuss ways in which the dispute can be resolved
Where the mediation is successful, the mediator will provide a settlement agreement. Once signed, the agreement is binding on both parties.
Where the mediation is unsuccessful, the mediator will provide a summary and attempt to mediate certificate that will be issued to both parties.
